Germany Smoking Ban

Planning a trip to Bavarian and Franconia for this fall. Was wondering if the flap about the smoking ban had died down. I assume it is still in effect, since hadn't heard any different, would hate to have to go back to sitting in a bunch of smokey bier halls and pubs.
